By purchasing, subscribing to, or using ClearLiving™ products, the customer agrees to the legally binding terms outlined below. This agreement ensures the proper use of ClearLiving™ products, protects the brand, and governs the rights and responsibilities of all parties involved.
1. Payment Policy
• Payments must follow the agreed schedule outlined in the purchase order or subscription plan.
• Late payments will incur 24% annual interest, calculated daily until the full amount is paid.
• ClearLiving™ reserves the right to suspend services, place a lien on installed equipment, or repossess products for non-payment. All costs associated with collections, legal fees, and repossession will be the customer’s responsibility.
2. Ownership and Usage Guidelines
• Products remain the property of ClearLiving™ until fully paid. Ownership transfers only upon complete payment for customers on subscription or installment plans.
• Customers must use the products in accordance with the official system manual, which overrides all promotional materials and marketing content.
• Unauthorized resale or use of ClearLiving™ products without permission is prohibited. ClearLiving™ will pursue legal action against counterfeit or unauthorized distributors.
3. System Performance and Water Quality Disclaimer
• Purification results are based on laboratory conditions and may vary based on real-world water quality and installation environments.
• ClearLiving™ products are sensitive to variations in base water quality. Additional equipment, such as water softeners, may be required for areas with high water hardness to ensure optimal performance.
• ClearLiving™ is not liable for performance issues caused by fluctuating water quality, improper installation, or environmental factors beyond its control.
4. No Liability for Improper Installation
• ClearLiving™ is not responsible for damages or product failures resulting from incorrect installation or modifications made by uncertified technicians.
• If the system is not installed according to the instructions in the system manual, the warranty is void.
• The customer or installer assumes full responsibility for proper installation and any related risks.
5. Subscription and Service Plans
• Subscription plans include filter replacements and technical support as specified in the service agreement.
• Customers may cancel their subscription with 30 days’ notice, subject to early termination fees.
• ClearLiving™ reserves the right to adjust subscription fees with 30 days’ notice before the next billing cycle.
6. Warranty and Liability
• ClearLiving™ products carry a one-year warranty covering defects in materials and workmanship.
• The warranty is void if the customer misuses the product, performs unauthorized modifications, or fails to follow maintenance guidelines in the system manual.
• ClearLiving™ will not be liable for indirect, incidental, or consequential damages such as lost profits, business interruptions, or property damage.
• Liability is limited to repair or replacement of defective products under the warranty.
7. Maintenance Requirements
• Customers are responsible for main
taining the product according to the instructions in the system manual.
• Failure to perform routine maintenance and filter replacements may void the warranty.
• ClearLiving™ reserves the right to conduct routine inspections of installed systems under subscription plans.
8. Brand Protection and Intellectual Property
• All ClearLiving™ products, trademarks, designs, and marketing materials are intellectual property protected by copyright and trademark laws.
• Unauthorized use, reproduction, or sale of ClearLiving™ products is strictly prohibited.
• ClearLiving™ monitors online platforms for counterfeit products and reserves the right to take legal action to protect its brand.
9. Dispute Resolution and Governing Law
• All disputes will be resolved through binding arbitration under the laws of Ontario, Canada.
• The prevailing party in any dispute will recover all reasonable legal fees and costs.
• This agreement is governed by the laws of Ontario, Canada, without regard to conflict-of-law principles.
10. Force Majeure
ClearLiving™ will not be held liable for delays or failures caused by events beyond its control, such as natural disasters, pandemics, or supply chain disruptions.
11. Entire Agreement
This agreement constitutes the entire understanding between the customer and ClearLiving™ and supersedes all prior agreements, representations, or warranties.
Acceptance of Terms
By proceeding with a purchase, subscription, or use of ClearLiving™ products, the customer acknowledges that they have read, understood, and agreed to the terms outlined in this agreement.
